Bankruptcy and other insolvencies

Supporting you when things get tough

Approximately 40% of Dutch companies do not survive the fifth year. Of course, this is not always because the business is not performing well, but still around 4,000 to 6,000 Dutch companies and institutions go bankrupt each year. If your company is heading for bankruptcy, there is a lot on your plate. Worries about your employees and the feeling of failure are intense.

Our lawyers have extensive experience with bankruptcies and impending insolvencies, as court-appointed receivers but also as lawyers for the company, its directors, supervisory directors and shareholders. This enables us to advise and litigate effectively, with an eye to all perspectives of the case.

What we can do for you

Would you like advice on filing for bankruptcy of a debtor who does not pay their debts? Or do you suspect that you will have to apply for a moratorium or file for your own bankruptcy? We are here for you! But also if a creditor has filed for your bankruptcy. We can defend you or lodge an opposition or appeal. And if bankruptcy cannot be avoided, we consult with the receiver as quickly as possible. Together with you, we will investigate restart scenarios and see whether you are legally well prepared for what is coming.

On your side

The receiver in bankruptcy does not only liquidate the company, but also investigates whether any fraudulent transactions have taken place prior to the bankruptcy and whether the directors are liable. If you are held liable, we will assist you.
